On March 23.03.2021, 10, state registrar Klimenko D.S., working in the Southern Interregional Directorate of the Ministry of Justice of Ukraine (Odessa, Staritsky St., XNUMX), registered a fraudulent protocol of the General Meeting of the “TsZI” on the appointment of Durach S.V. director of TsZI.
This protocol is invalid, because according to the Charter of “CZI”, a general meeting can be held only if more than 50% of the organization’s members are present. At that time, there were 7 members in “TsZI”. That is, in order to hold a general meeting, the participation of at least four members of the “CZI” was necessary. The illegality of the Protocol was also confirmed by the decision of the Economic Court of Odessa in case 916/2766/21. Registrar D.S. Klimenko committed a crime by registering a fraudulent protocol.
His actions fall under the articles of the Criminal Procedure Code of Ukraine:
- Art. 364 of the Criminal Code of Ukraine. Abuse of power or official position;
- Art. 365–2. Abuse of powers by persons providing public services;
- Art. 27 Part 5 of the Criminal Code of Ukraine defines his actions as an accomplice to a criminal crime.
The investigator of the State Investigative Directorate of the NP of Ukraine I. Borets and the prosecutor of the Office of the Prosecutor General S. Pilipenko refused to initiate a criminal case against the state registrar D. Klimenko. D. Klimenko was not even interrogated.
